The incident took place at an Atlanta restaurant called The Varsity in the days following the Super Bowl in 2019. Local police issued several arrest warrants for Durk — the charges included criminal intent to commit murder, aggravated assault, possession of a firearm during commission of a felony, possession of a firearm by a convicted felon, and for unlawful association with a gang in the participation of a crime.

As the charges were revealed, Durk promptly announced on Instagram that he was surrendering to the police. He declared his innocence in a song called "Turn Myself In" shared on his SoundCloud.
